If you do not agree to these terms, you must not use the Site. We reserve the right to modify these terms at any time, and your continued use of the Site constitutes acceptance of any modifications.
You may use the Site for lawful purposes only and in accordance with these Terms. You agree not to use the Site in any way that violates any applicable local, national, or international law or regulation; to transmit or procure the sending of any advertising or promotional material without our prior consent; to impersonate or attempt to impersonate Obsidian Studio, an Obsidian Studio employee, or any other person or entity; or to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site.
The Site and its entire contents, features, and functionality — including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof — are owned by Obsidian Studio, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent.
All project work undertaken by Obsidian Studio is governed by separate project agreements that will be provided to clients before work begins. The information presented on this Site regarding our services, pricing, and deliverables is for general informational purposes only and does not constitute a binding offer. Specific project terms, timelines, and pricing will be detailed in individual proposals and contracts.
In no event shall Obsidian Studio, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Site; any conduct or content of any third party on the Site; any content obtained from the Site; or unauthorized access, use, or alteration of your transmissions or content.
The Site is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. Obsidian Studio disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Obsidian Studio operates, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of the applicable jurisdiction, and you hereby consent to personal jurisdiction and venue therein.
